The primary purpose of seeking design registration is to obtain protection for the features of shape, configuration, pattern or ornaments. A design may consist of three-dimensional aspects, such as the shape or configuration of an article, or of two-dimensional features, such as patterns or ornaments.
Here, the terms “pattern” and “ornament” refer to something that is embossed, engraved or placed upon an article for decorative purpose. Once design registration is done, it awards the rights for a period of 15 years applicable from the date of application. The registration remains valid for a preliminaryperiod of 10 years and can be renewed for another 5 years. These rights include the use of the design for ten years.
